Your privacy is very important to the South African Broadcasting Corporation (SOC) Ltd (“SABC”). SABC has developed this statement to help you to understand how we collect, communicate and use any personal information that you submit to us. For purposes of this statement, “personal information” shall be defined as detailed in the Protection of Personal Information Act 4 of 2013 (“POPI”).

Personal Information We Collect

SABC collects and processes your personal information mainly to provide services and products to you and to help improve our offerings to you. Where possible, we will inform you what information is voluntary or mandatory for you to provide to us and the consequences for failing to provide the requested information.

We will only retain your personal information as long as necessary for the fulfilment of those purposes as have been identified by us.

SABC processes the above-mentioned personal information only for the purposes which it was collected, as authorised by law or as agreed with you, for example:

Information Security

SABC shall take all reasonable steps to secure the content of the SABC+ website and the information provided by and collected from users from a wide variety of security breaches such as unauthorized access and/or disclosure, etc. However, SABC does not make any warranties or representations that content shall be 100% safe or secure, but SABC will have applied all necessary due care and diligence towards preserving the security of information Subject to the provisions of sections 43(5) and 43(6) of the ECT Act (Electronic Communications and Transactions Act No 25 of 2002) - - and the requirements for a valid electronic invoice issued by the South African Revenue Service from time to time, if applicable, SABC is under no legal duty to encrypt any content or communications from and to users and is also under no legal duty to provide digital authentication of any pages on the SABC+ website.

Users may not deliver or attempt to deliver, whether on purpose or negligently, any damaging code, such as computer viruses, robots or spyware, to the SABC+ website or the server and computer network that support the SABC+ website.

Notwithstanding criminal prosecution, any person who delivers or attempts to deliver any damaging code to the SABC+ website, whether on purpose or negligently, shall, without any limitation, indemnify and hold SABC harmless against any and all liabilities, damages, risks and losses that SABC and its partners/affiliates may suffer as a result of such delivery, attempt or damaging code.

Users may not develop, distribute or use any device or program designed to breach or overcome the security measures of the restricted pages, products and services on the SABC+ website. SABC reserves the right to claim damages from any and all persons involved, directly and indirectly, in the development, use and distribution of such devices or programs.

Users who commit any of the offences detailed in sections 85 to 88 of the ECT Act - - shall, notwithstanding criminal prosecution, be liable for all resulting liabilities, losses, destruction or damages suffered and/or incurred by SABC and its partners/affiliates due to or related to these illegal actions.
